Welcome to MyMuute. These Terms of Service (“Terms“) govern your use of the MyMuute website, services, and applications (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. Please read these Terms carefully before using our Service. If you do not agree to these Terms, you may not access or use the Service.
1. Definitions
- "MyMuute" refers to our company, platform, website, and services.
- "Users" refers to individuals who access or use the Service, including Musicians and Event Organizers.
- "Musicians" refers to individuals or groups who offer musical services through our platform.
- "Event Organizers" refers to individuals or organizations who book Musicians through our platform.
- "Content" refers to text, graphics, images, music, software, audio, video, works of authorship, or any other materials uploaded, posted, or displayed on the Service.
2. Account Registration
To use certain features of the Service, you must create an account and provide certain information about yourself.
- Providing accurate, current, and complete information during registration.
- Maintaining the security of your account and password.
- All activities that occur under your account.
- Notifying MyMuute immediately of any unauthorized use of your account.
MyMuute reserves the right to refuse service, terminate accounts, or remove Content in our sole discretion.
3. Booking and Payment Terms
3.1 For Event Organizers:
- When you book a Musician through our Service, you are entering into a contract directly with that Musician.
- You agree to pay all fees associated with your bookings.
- MyMuute charges a service fee for facilitating bookings through our platform.
- Cancellation policies are set by the Musicians and will be clearly displayed before booking.
3.2 For Musicians:
- You are responsible for setting your own rates and availability.
- MyMuute charges a commission fee on successful bookings.
- You must maintain accurate and up-to-date information about your services.
- You are responsible for fulfilling all bookings accepted through the platform.
3.3 Payment Processing:
- All payments are processed through our secure payment processors.
- MyMuute holds payment in escrow until services are completed.
- Payments to Musicians are released according to our payment schedule.
- All fees and payment terms are in Nigerian Naira (₦) unless otherwise specified.
4. User Conduct
You agree not to:
- Use the Service in any way that violates any applicable laws or regulations.
- Impersonate any person or entity.
- Engage in any harassing, abusive, or harmful conduct toward other users.
- Attempt to circumvent any security features of the Service.
- Use the Service to transmit spam, chain letters, or other unsolicited communications.
- Upload or transmit viruses, malware, or other malicious code.
- Attempt to access, search, or scrape the Service by any means other than the provided interface.
5. Content Rights and Responsibilities
5.1 User Content:
- You retain ownership rights to Content you submit to the Service.
- By submitting Content, you grant MyMuute a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such Content.
- MyMuute charges a service fee for facilitating bookings through our platform.
- You are solely responsible for all Content you submit or display through the Service.
5.2 Prohibited Content:
You may not post Content that:
- Infringes on intellectual property rights of others.
- Contains false, defamatory, or misleading statements.
- Contains hate speech or discriminatory content.
- Depicts violence or illegal activities.
- Contains adult, obscene, or pornographic material.
- Violates any person's privacy or publicity rights.
6. Dispute Resolution
6.1 Between Users:
If a dispute arises between an Event Organizer and a Musician, both parties agree to:
- First attempt to resolve the dispute directly between themselves.
- If direct resolution fails, submit the dispute to MyMuute's mediation process.
- Provide all necessary information to help MyMuute make a fair decision.
6.2 With MyMuute:
For any disputes with MyMuute, you agree to:
- First contact us at disputes@mymuute.com to attempt to resolve the issue.
- If the issue cannot be resolved, disputes shall be resolved through binding arbitration in Lagos, Nigeria.
7. Limitation of Liability
To the maximum extent permitted by law:
- MyMuute is not liable for any indirect, incidental, special, consequential, or punitive damages.
- Our liability is limited to the amount you have paid to MyMuute in the past six months.
- MyMuute does not guarantee the quality, safety, or legality of any musical services
- We do not guarantee that the Service will be error-free or uninterrupted.
8. Termination
MyMuute may terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will post the updated Terms on this page and update the"Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.
